Terms of Service

In force from 14 October 2026 · version 2.0

This is a business agreement. Loyalty Cards is sold only to businesses, for use in a business. It is not a consumer product and it is not ordinarily acquired for personal, domestic or household purposes, so the consumer-protection regime that applies to shopping does not apply to this agreement. You are contracting as a business and you confirm that when you sign up.

Your own customers are not party to this agreement and gain no rights under it. Their relationship is with you.

1. Who this is between

This agreement is between Aivolux Technologies (Business Registration No. JM1051832-K), Malaysia, trading as Loyalty Cards (“we”, “us”), and the business that opens an account (“you”). It covers the website at loyaltycards.click, the application at app.loyaltycards.click, and everything we provide through them.

Aivolux Technologies is the contracting party and the entity that takes payment. Loyalty Cards is the name of the service.

You agree to these terms when you create an account. If you are agreeing on behalf of a company or firm, you confirm that you are authorised to bind it, and “you” means that business.

2. What the service is

We provide software that lets a business run a digital stamp card: a card your customers open in a browser, a way for your staff to add stamps, and a record of who has earned what. We provide the software. We do not provide the reward.

We may change, add to or withdraw features. Where a change removes something you are actively relying on, we will tell you before it happens. We are not obliged to keep any particular feature for any particular period.

3. Your account

  • One person signs up and may run several businesses from that one login. Each business is billed separately and has its own plan.
  • Keep your password to yourself. Anything done with your login is treated as done by you, and you are responsible for it.
  • You are responsible for everyone you give access to, including staff and anyone you add to your team.
  • Tell us promptly if you believe somebody has your login.
  • You must give us accurate account and billing details and keep them current.

4. Price and payment

Prices are in Malaysian Ringgit and are shown on the pricing page. At the date of these terms:

PlanPriceWhat it includes
StarterRM25 / month One branch, one loyalty programme. Unlimited customers.
UnlimitedRM75 / month Unlimited programmes and customers. Additional branches RM15 each per month.
  • Subscriptions run monthly and renew automatically until cancelled.
  • Payment is taken in advance for each period. Access depends on payment being received.
  • Prices exclude Sales and Service Tax and any other tax or levy. Where tax becomes chargeable we will add it to your invoice and you will pay it.
  • If a payment fails we may retry it. If it is still unpaid we may suspend the account under section 14.
  • Bank charges, card fees and currency conversion costs are yours.
  • We may change prices on 30 days' notice by email. The new price applies from your next renewal. If you do not accept it, cancel before that renewal.

5. The free trial

New businesses get seven days free. We do not take card details to start it. The trial is the full product.

At the end of the trial the account pauses until you choose a plan. We may change or withdraw the trial offer at any time, and we may refuse a trial to anybody who has already had one.

6. Cancelling, and refunds

You can cancel at any time from the Billing page. Cancelling stops the next renewal. Your plan runs to the end of the period you have already paid for.

Fees are not refundable. We do not refund the unused part of a period, we do not refund because an account was not used, and we do not refund part-months on cancellation, downgrade or closure of a branch. This is a business agreement for a monthly service you can cancel at any time, and the price reflects that.

There are three exceptions, and only three:

  1. Where Malaysian law requires a refund. If any provision of Malaysian law gives you a right to a refund that cannot be excluded by agreement, that right stands and nothing here reduces it.
  2. A payment taken in error. A duplicate charge, a charge after you cancelled, or a charge for a plan you did not have. Tell us within 60 days and we will return it.
  3. A total failure of the service caused by us. If the service is wholly unavailable for more than 72 consecutive hours because of something within our control, you may ask for a credit for the affected days against your next invoice. This is a credit, not a cash refund, and it is the only remedy for unavailability.

Nothing is deleted when you stop paying. Your customers and every stamp they earned stay where they are. The card pauses — staff cannot add stamps and rewards cannot be claimed — until you subscribe again. How long we keep a paused account is in section 14.

7. Your customers and their data

The people who join your card are your customers. Their names, phone numbers and email addresses are personal data under the Personal Data Protection Act 2010, and you are the data user in respect of them. We process that data on your instructions, as your data processor, and for no other purpose.

You confirm and promise that:

  • You have collected those details lawfully and told the people concerned what they are used for, as the PDPA requires.
  • Anybody you upload, import or enter has consented to be on your card, and anybody you send marketing to has consented to that separately.
  • You will deal with requests from your own customers to see, correct or delete their details. We will help, and we will pass on anything that reaches us.
  • You will not use the service to contact people who have not agreed to hear from you.

We do not sell your customer list, we do not market to your customers, and we do not use their details for anything other than running your card. Our full privacy practices are in the Notis Privasi.

8. Your rewards are yours to honour

We record that a card is full. We do not give anybody anything. The reward is a promise between you and your customer, and honouring it is entirely your responsibility — including if your records and ours disagree, if a customer disputes what they were promised, or if you change or withdraw the offer.

You are responsible for making sure what you offer is lawful, that it is described accurately, and that it complies with every law that applies to you — including the Consumer Protection Act 1999, the Trade Descriptions Act 2011 and any rule that applies to your trade. We have no liability to your customers and none to you arising from a reward, an offer, or the way either is described.

9. What you must not do

  • Add people who have not agreed to join, or buy a list and upload it.
  • Use the service to send marketing to anyone who has not consented.
  • Use it for anything unlawful, deceptive, or for a scheme where the reward depends on recruiting other people.
  • Resell, sub-licence, white-label or otherwise make the service available to a third party as your own.
  • Copy, decompile, reverse engineer or attempt to derive the source of any part of it, except to the extent the law expressly permits.
  • Attack it, probe it, scrape it, overload it, or try to reach another business's data.
  • Share one account across businesses that are not yours, or let your login be used by somebody outside your team.

If you do any of these we may suspend or close the account immediately and without refund.

10. Availability and support

We provide the service with reasonable care and skill. We do not promise it will be uninterrupted, timely, secure or free of faults, and we give no service level or uptime guarantee. We may take it down for maintenance, and we will give notice where it is practical to do so.

Support is by e-mail and through the Help screen in the app, in English or Bahasa Malaysia, during Malaysian business hours. Our helpdesk aims to reply within the hour during those hours. Where it cannot settle something, a specialist takes it on: for an Unlimited business those are picked up first, and for a Starter business within one working day. These are targets we work to, not contractual commitments, and a message sent outside business hours is answered from the start of the next one.

The service depends on third parties — hosting, payment processing, email delivery, messaging platforms and the customer's own browser and network. We are not responsible for a failure of any of those.

11. Who owns what

We own the service. The software, the design, the card templates, the name and everything else we provide remain ours. You get a non-exclusive, non-transferable right to use it while your subscription is live, and nothing more. No other right or licence is granted, expressly or by implication.

You own your data. Your business details, your customer list and your stamp records are yours. You can export them while your account is live. Giving us the data gives us the right to host, process and display it in order to provide the service.

We may use anonymous, aggregated statistics — numbers that identify neither you nor any individual — to run, improve and describe the service.

If you send us an idea or a suggestion, we may use it without owing you anything.

12. Our liability

To the fullest extent permitted by Malaysian law:

  • The service is provided as it is and as available. All warranties, conditions and terms implied by statute or common law are excluded, so far as the law allows them to be.
  • We are not liable for loss of profit, loss of revenue, loss of business, loss of goodwill, loss of anticipated savings, loss of or corruption of data, or any indirect or consequential loss, however it arises.
  • We are not liable for anything your customers do, for any dispute between you and a customer, or for any reward you did or did not honour.
  • Our total liability to you, for everything, is limited to the fees you actually paid us for the affected business in the three months before the claim arose. Where no fee has been paid, our total liability is RM100.
  • Any claim must be brought within twelve months of the date you first became aware of the matter complained of.

What we cannot exclude, we do not try to. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that Malaysian law does not permit to be excluded or limited. A clause attempting that would be void anyway, and we would rather this document said only things that hold.

13. Your indemnity

You will indemnify us, and keep us indemnified, against all claims, demands, proceedings, losses, damages, fines and reasonable legal costs arising out of or in connection with:

  • your use of the service, or use by anybody you gave access to;
  • any reward, offer or statement you made to your customers;
  • any claim by one of your customers, including about their personal data;
  • your breach of these terms or of any law that applies to you, including the PDPA.

14. Suspension and ending it

You may cancel at any time from the Billing page.

We may suspend or close an account:

  • immediately, if payment is more than 14 days overdue;
  • immediately, if you breach section 9, or if we reasonably believe the account is being used unlawfully or in a way that puts other businesses at risk;
  • immediately, if required by law or by a regulator;
  • at any time for any other reason, on 30 days' notice by email. In that case only, we will refund the unused part of the period you have paid for.

When an account is suspended, its staff cannot sign in, its join page closes and its cards stop opening. Nothing is deleted.

When an account is closed or paused, we keep its data for 12 months so you can come back to it. After that we may delete it, and we will email you first. Billing records are kept for seven years because tax law requires it.

15. Changes to these terms

We may change these terms. We will post the new version here with a new date, and for a change that materially reduces what you get we will email you at least 30 days before it takes effect.

Continuing to use the service after a change takes effect means you accept it. If you do not, cancel before then.

16. Things outside our control

We are not liable for any failure or delay caused by something beyond our reasonable control — including internet or power failure, the act or failure of a hosting, payment or messaging provider, fire, flood, epidemic, industrial action, civil disturbance, or an act of government.

17. General

  • Whole agreement. These terms and the Privacy Notice are the whole agreement between us about the service, and replace anything said or written before. You confirm you have not relied on any statement that is not written here.
  • No waiver. If we do not enforce something, that is not a waiver of it and we may enforce it later.
  • Severance. If a provision is found unenforceable, the rest stands, and that provision applies to the greatest extent the law allows.
  • Assignment. You may not transfer this agreement without our written consent. We may transfer it — on a sale or reorganisation of our business, for example — and will tell you.
  • No third parties. Nobody who is not a party to this agreement has any right to enforce any part of it.
  • Notices. We will write to the email address on your account. It is your job to keep it current. Notices to us go to support@loyaltycards.click.
  • Language. These terms are written in English. If we publish a translation and the two differ, the English version governs.

18. Law and disputes

This agreement is governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction, and you submit to them.

Before starting proceedings, email us and give us 30 days to put it right. Almost everything is settled faster that way than through anyone's lawyer. Nothing in this paragraph prevents either of us from seeking an injunction where one is needed urgently.
